The process of buying a home in Spain, step by step

From the NIE to the keys: the 6 steps every foreign (and Spanish) buyer follows when purchasing a new build on the Costa Blanca.

Buying a home in Spain is a safe, well-regulated process, but it helps to know the stages before you start.

1. The NIE The Foreigner Identification Number is essential for any transaction: no NIE, no purchase. You can apply at a police station in Spain or at the Spanish consulate in your country.

2. A Spanish bank account Not required by law, but highly recommended: it simplifies paying taxes, utilities and community fees.

3. Reservation and deposit contract Once you have chosen your home, you sign a reservation document (usually €3,000–10,000) and then the deposit contract (contrato de arras), which sets the price, deadlines and penalties if either party withdraws. For new builds, advance payments are guaranteed by law through a bank guarantee or insurance.

4. Legal review An independent lawyer checks charges, licences and that the developer complies with Spanish Building Act 38/1999. The cost (≈1% of the price) buys peace of mind.

5. Signing before a notary The sale is formalised in a public deed before a notary, who verifies identity, charges and payments. That is the day you receive the keys.

6. Registration and taxes After signing, taxes are settled and the deed is registered at the Land Registry. From that moment, the home is officially yours.
